1. Champion Data and Privacy

Champion Data Pty Ltd ACN 073 008 063 and Champion Data Holdings Pty Ltd ACN 090 641 553 (collectively Champion Data) understand your privacy is important and the importance of protecting the privacy of an individual’s personal information.

This privacy policy outlines how Champion Data manages the personal information that Champion Data collects, holds, uses and discloses.

Champion Data is a company that prides itself on deriving value out of sports data and content for a wide range of organisations and businesses such as sporting bodies and clubs, media organisations and betting operators.

In handling personal information, Champion Data will comply with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles in the Privacy Act (subject to exemptions that may apply to Champion Data under the Privacy Act, such as the employee records exemption or the related bodies corporate exemption).

Champion Data will regularly review its policies and procedures regarding personal information and may therefore update and amend this Privacy Policy from time to time.

Any updated Privacy Policy will be made available on the website at www.championdata.com.au  or otherwise on request from Champion Data.

2. Who does Champion Data collect personal information about

Personal information includes a broad range of information, or an opinion, that could identify an individual. What is personal information will vary, depending on whether a person can be identified or is reasonably identifiable in the circumstances.

In order to conduct its business, Champion Data may collect personal information such as:

  • individuals who acquire or use products or services from Champion Data or otherwise interact with Champion Data;
  • athletes or sportspeople who participate in the sports or other events in respect of which Champion Data provides sports statistics, sports information, sports publication services or other similar services; and
  • coaches, officials, team representatives and other similar individuals who participate in the sports or other events in respect of which Champion Data provides sports statistics, sports information, sports publication services or other similar services.

If you express an interest in working for Champion Data or submit your CV to Champion Data (whether in response to an advertised position or otherwise), Champion Data may retain your CV or other personal information you submit to Champion Data for the purpose of contacting you regarding any employment opportunities with Champion Data which Champion Data considers may be of interest to you.

3. What kinds of personal information does Champion Data collect

The kinds of personal information Champion Data collects will vary depending on the types of dealings or interactions Champion Data has with you, including via email.

If you acquire or use products or services from Champion Data or otherwise interact with Champion Data regarding our products or services, the kinds of personal information Champion Data may collect regarding you include:

  • your name, residential or business address, telephone number, email address, date of birth, occupation, credit card or other payment related information;
  • images, photos and videos; and
  • information regarding the products or services you have acquired or used from Champion Data or enquired about.

In addition, to, amongst other things, understand what services on our websites, services and apps interest you in order to improve the services we offer and your experience when you are on our websites, services and apps, you may also provide to Champion data and we may collect and hold additional information such as:

  • the internet protocol (IP) address of the device you are using;
  • cookie ID and other online user identifier(s);
  • information on how you use our websites, services and apps (e.g. the web pages visited by you on our websites) and how you interact with our interactive features and respective contents;
  • your device type (e.g. iPhone), your browser type (e.g. Chrome), your operating system (e.g. iOS), your screen resolution;
  • date and time of access of our websites and/or apps;
  • personal preferences including your wish lists and marketing and cookie preferences; and
  • account log-in information (e.g. username, security question).

If you are an athlete, sportsperson, coach, official or team representative, Champion Data may collect statistical or other information relevant to your participation in the sports in respect of which Champion Data provides sports statistics, sports information, sports publication services or other similar services, including data and information collected by third parties. Such information may include:

  • Identity data – includes first name, last name, nickname(s), unique identification code (for internal purposes), gender, nationality, date of birth and images of individual;
  • Professional data – includes sport played, role or position of individual in their sport, playing position, preferred foot or hand of individual, playing number, current and previous teams or clubs;
  • Athlete tracking data – includes player location co-ordinates and biometric data;
  • Health data – includes information about an individual, for example information made publicly available by an athlete or club regarding injuries to athletes or sportspeople who participate in the sports in respect of which Champion Data provides sports statistics, sports information, sports publication services or other similar services;
  • Performance data – includes appearance data (such games and minutes played), disciplinary information, information relating to performance (such as scoring and event data), awards received and other playing history data;
  • Recruitment data – includes health information relating to you (which may include medical reports or assessments relating to you);
  • News data – includes news relating to individual (such as an individual’s availability for forthcoming games, competitions or events);
  • Contact data – includes social media handles and individual’s official website.

4. How does Champion Data collect personal information

Champion Data will generally seek to collect personal information directly from you, for example when you purchase products or services from Champion Data, sign up for a Champion Data newsletter or similar service or otherwise interact with Champion Data.

In some cases, Champion Data may collect your personal information from sources other than you such as from an information services provider, from a publicly maintained record or other publicly available sources of information or using its own information collection resources.

During the course of business, Champion Data may also collect personal information from a third-party contractor, such as sports measurement device provider. This information forms part of the personal information described in this Privacy Policy. Champion Data will not intentionally solicit personal information that is unintentionally disclosed.

5. Why does Champion Data collect, hold, use and disclose personal information

Champion Data primarily collects, holds, uses and discloses personal information for the purposes of providing Champion Data’s sports statistics, sports information, sports publication services, software applications and other similar services.

This may include using and/or disclosing personal information to facilitate or otherwise in connection with:

  • Champion Data providing its sports statistics, sports information, sports publication services, software applications and other similar services;
  • Champion Data keeping and maintaining statistics databases regarding sports, sporting teams, athletes, sportspeople or sports officials;
  • Champion Data providing recruitment services for sporting clubs and leagues;
  • Champion Data providing player profiles as part of our service offering to our clients;
  • Champion Data providing services to wagering operators in their offering and settling player-related betting markets of sporting competitions and related events;
  • Champion Data verifying your identity, processing payments made by you to Champion Data or otherwise managing your relationship with Champion Data;
  • Champion Data communicating with you regarding its sports statistics, sports information, sports publication services, software applications and other similar services;
  • Champion Data providing you with information about events, products or services of Champion Data or its commercial partners that may be of interest to you;
  • Champion Data promoting and marketing Champion Data and or the products, services or events of Champion Data;
  • Champion Data undertaking research;
  • Champion Data improving its website, apps and other online services and to facilitate the internal business operations of Champion Data;
  • Accounting, billing and other internal administrative purposes of Champion Data; and
  • Complying with the obligations of Champion Data under any applicable laws;
  • Champion Data providing to third party service providers in connection with any of the above; and
  • Champion Data’s obligation to identify risk and implement appropriate controls to prevent or manage public health responses to pandemics or similar occurrences, including COVID-19, including by providing personal information to relevant Government and health authorities, upon request, to assist with contact tracing.

Champion Data may also use and disclose your personal information for purposes related to the above purposes and for which you would reasonably expect Champion Data to do so in the circumstances, or where you have consented or the use or disclosure is otherwise in accordance with law.

Where personal information is used or disclosed, Champion Data takes steps reasonable in the circumstances to ensure the personal information is relevant to the purpose for which it is to be used or disclosed.

By providing us with personal information, you consent to that information being collected, used, disclosed and stored in accordance with this Privacy Policy.

Where we engage with you multiple times over a short period in relation to the same matter, we may not provide you with a separate notice about privacy each time we engage with you however we will provide you with an opportunity to opt–out of receiving communications about that matter within each of those communications.

You are under no obligation to provide your personal information to Champion Data. However, without certain information from you, Champion Data may not be able to provide its services to you.

6. Disclosure of personal information by Champion Data

Champion Data engages third parties to perform services in connection with the operation of our business. This may include disclosing personal information to:

  • recipients of Champion Data’s sports statistics, sports information, sports publication services, software applications and other similar services;
  • third parties engaged by Champion Data to perform administrative or other business management functions for Champion Data, including (without limitation) web hosting providers, IT systems administrators, mailing houses, payment processors, data entry service providers, fraud protection and credit risk reduction, product customisation, website evaluation, data analysis, data cleansing and electronic network administrators;
  • Champion Data’s commercial and business partners (including Champion Data’s joint venture partners, shareholders and other parties that Champion Data has a commercial relationship with from time to time);
  • Champion Data’s professional advisors, contractors, consultants and related bodies corporate; and
  • Champion Data’s insurance providers.

Champion Data may need to share personal information with these third parties so that they can perform these services, however, we limit the personal information that we give to them and authorise them to use this information only for the purpose of performing those services.

Champion Data discloses personal information for the purpose for which Champion Data collects it.

Champion Data may also disclose personal information to a third party with the consent of the relevant individual or if the disclosure is required or authorised by law.

7. Direct marketing

Champion Data may use and disclose your personal information in order to inform you of products and services of Champion Data, Champion Data’s related bodies corporate or Champion Data’s commercial or business partners that may be of interest to you.

This may include Champion Data disclosing your personal information to related bodies corporate of Champion Data or other entities with which Champion Data has a commercial relationship or arrangement for the purpose of such other entities contacting you regarding offers or information (which may include offers or information about the products or services of such other entity).

8. Opt-out/unsubscribe

You can unsubscribe at any time you want to from Champion Data communications by contacting us using the contact details specified in this Privacy Policy or by following the instructions contained in an e-mail.

It may take some time to put an opt-out or an unsubscribe in effect so you may still receive communications from us for several weeks after your request is received.

For the avoidance of doubt, by opting–out or unsubscribing yourself from a mailing list of a product or service this will ensure your removal from that particular mailing list but will not guarantee your removal from other mailing lists that may store your details in as a result of your engagement with a different service or product.

9. Cookies and pixel tags

Champion Data may use a variety of methods such as cookies and pixel tags to collect information. Usually, cookies and pixel tags are used as a means for our websites to remember your preferences and are thus designed to improve your user experience. Cookies may collect and store personal information about you.

You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is sent. Each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences.

If you disable the use of cookies on your web browser or remove or reject specific cookies from our website or linked sites then you may not be able to gain access to all of the content and facilities on our website.

Champion Data websites, services and apps may contain links to other websites that we do not own or operate. Champion Data does not control, recommend or endorse the content, products, services, privacy policies or practices of these third-party websites. For example, on our websites may have clickable icons which take you to a Facebook page or a Twitter page. If you choose to click on these links, you should know that Facebook and Twitter may send their own cookies to your device and they may collect personal data. It is therefore important that you also read Facebook’s and/or Twitter’s privacy policies.

Champion Data treats personal information that may be obtained through cookies and any other information supplied to us in accordance with this Privacy Policy.

10. Links to third party’s websites

Champion Data websites, services and apps may also contain links to other websites that we do not own or operate. Champion Data does not control, recommend or endorse the content, products, services, privacy policies or practices of these third-party websites. We do not accept any responsibility or liability for such third-party websites.

11. Website analytics

When you visit and browse Champion Data websites our website host and some third-party service providers may collect information for statistical, reporting and maintenance purposes.

Subject to the terms of this Privacy Policy, this information is used to administer and improve the performance of our websites and will not be used to identify you. The information may include:

  • the number of users visiting our website and the number of pages viewed;
  • the date, time and duration of a visit;
  • visiting patterns of individuals accessing websites;
  • the IP address of your computer; and
  • the path taken through our website.

Website analytics generate statistical and other information about website use by means including but not limited to cookies which are stored on users’ computers. The information generated is used to create reports about the use of websites. Our third-party providers of these services may store this information.

12. Children’s privacy

If you are under 18, you should only use Champion Data websites, services and apps with involvement of a parent or guardian. For their protection, we ask that anyone under 18 years of age does not attempt to provide us with any personal information without the consent of a parent or legal guardian.

13. Security of personal information

Champion Data takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference and loss and from unauthorised access, modification or disclosure.

Champion Data holds personal information in both hard copy and electronic forms in secure databases on secure premises. Champion Data implements data security and physical security practices and procedures including firewalls and premises access controls.

Personal information may also, in certain circumstances, be held on behalf of Champion Data in hard copy or electronic forms by Champion Data’s service providers (such as offsite document storage providers or electronic data storage providers). Champion Data enters into agreements with such service providers which impose confidentiality and privacy obligations on the service provider.

14. Overseas disclosure

Wherever reasonably practicable, Champion Data will store personal information on data servers that are owned and controlled by Champion Data and that are located within the geographical borders of Australia. However, some of your personal information may be transferred, stored, processed, used or disclosed overseas by Champion Data or by Champion Data’s third-party service providers. In particular, at the date this Privacy Policy was most recently updated, your personal information may be disclosed to recipients in the USA, China and other countries from time to time.

This may happen if our service providers are located overseas, or if transactions, information, services or products have an overseas connection. Where such parties are located overseas, you may have rights to enforce such parties’ compliance with applicable data protection laws, but you may not have recourse against those parties under the Australian Privacy Act (Cth) 1988 in relation to how those parties treat your personal information.

You agree to the disclosure and use of such personal information in accordance with this Privacy Policy, and consent to its disclosure overseas and its use by third parties, including our service providers, in the USA, China and such other countries in which those parties or their computer systems may be located from time to time, where it may be used solely for the purposes described in this Privacy Policy, without us being responsible for such use (or for any breach).

Where Champion Data use cloud computing services we will use our reasonable endeavours to ensure that such disclosures are in compliance with Australian privacy laws.

15. Information security

Champion Data will take reasonable steps to protect all personal information within its direct control from misuse, interference, loss, unauthorised access, modification or disclosure.

Champion Data will take reasonable steps to hold information securely in electronic or physical form in access controlled premises or in electronic databases requiring logins and passwords.

16. Notifiable data breaches

In the event of any loss, or unauthorised access or disclosure of your personal information that is likely to result in serious harm to you, Champion Data will investigate and notify you and the Australian Information Commissioner as soon as practicable, in accordance with the Privacy Act 1988 (Cth).

17. Access and correction

Champion Data takes steps reasonable in the circumstances to ensure personal information it holds is accurate, up-to-date, complete, relevant and not misleading.

In some jurisdictions, you have a right to seek access to and correction of your personal information that is collected and held by Champion Data.

If at any time you would like to access or correct the personal information that Champion Data holds about you, please contact Champion Data’s Privacy Compliance Officer on the details set out below.

Champion Data will grant access to the extent required or authorised by the Privacy Act or other law and take steps reasonable in the circumstances to correct personal information where necessary and appropriate.

To obtain access to your personal information:

  • you may be required to provide proof of identity to ensure that personal information is provided only to the correct individuals and that the privacy of others is protected;
  • Champion Data requests that you be reasonably specific about the information you require; and
  • Champion Data may charge you a reasonable administration fee, which reflects the cost to Champion Data for providing access in accordance with your request.

If Champion Data refuses your request to access or correct your personal information, Champion Data will provide you with written reasons for the refusal and details of complaint mechanisms available to you. If Champion Data provides access to your personal information, Champion Data will take steps reasonable in the circumstances to provide you with access in a manner that meets your needs and the needs of Champion Data.

Champion Data will endeavour to respond to your request to access or correct your personal information within 30 days from your request.

19. Privacy complaints

Please direct all privacy complaints to Champion Data’s Privacy Compliance Officer (contact details are set out above). At all times, privacy complaints:

  • will be treated seriously by Champion Data;
  • will be dealt with promptly by Champion Data;
  • will be dealt with by Champion Data in a confidential manner; and
  • will not affect your existing obligations or affect the commercial arrangements between you and Champion Data.

Champion Data’s Privacy Compliance Officer will commence an investigation into your complaint. You will be informed of the outcome of your complaint following completion of the investigation. In the event that you are dissatisfied with the outcome of your complaint, you may refer the complaint to the Office of the Australian Information Commissioner.
